If someone owes me $10,000.00 and refuses to pay me back with a signed agreement, can I deduct it as bad debt?

If I have signed documentation on a personal loan can I deduct it as bad debt? Also, if the amount is $10,000.00 can I deduct it over a period of three years, considering the maximum amount allowed is $3,000.00?

I want to file jointly because we are going to get more refund. But I heard that if we file jointly creditors can come after my wife because of my bad credit. Is this true? Please note that most of my bad credit was before we were married. I only have a couple items that went in collection after we were married. I can easily pay them off.
